 1. Preliminary Provisions

The online store Eliada, available at www.eliada.store, is operated by:

These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Store. They define the rules for using the online Store as well as the terms and procedures for concluding Distance Sales Agreements with the Customer through the Store.

2. Definitions

  • Consumer – a natural person who enters into a contract with the Seller through the Store, where the subject of the contract is not directly related to their business or professional activity.

  • Seller – Eliada Marta Koch, NIP: 6252465701, REGON: 380715664.

  • Customer – any entity placing an Order via the Store.

  • Entrepreneur – a natural or legal person, or an organizational unit with legal capacity granted by law, conducting business activity in their own name, using the Store.

  • Store – the online store operated by the Seller at www.eliada.store.

  • Distance Agreement – a contract concluded with the Customer within an organized system of concluding distance contracts (i.e., through the Store), without the simultaneous physical presence of the parties, using one or more means of remote communication.

  • Terms and Conditions – these terms and conditions of the Store.

  • Order – a Customer’s declaration of will made via the Order Form, aimed at concluding a Sales Agreement for a Product or Products with the Seller.

  • Account – a Customer’s individual account in the Store that stores data provided by the Customer and information about Orders placed.

  • Registration Form – a form available in the Store that allows for the creation of an Account.

  • Order Form – an interactive form available in the Store that enables the placement of an Order, in particular by adding Products to the Cart and defining delivery and payment options.

  • Cart – a feature of the Store software where the Customer’s selected Products for purchase are visible, and the Order data can be reviewed and modified.

  • Product – a movable item or service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.

  • Sales Agreement – a contract for the sale of a Product concluded or entered into between the Customer and the Seller through the Store. Depending on the nature of the Product, it may also refer to a contract for the provision of services or a contract for a specific task (custom work).

4. Technical Requirements

To use the Store, browse its assortment, and place Orders, the following are required:

  • A device with Internet access and a web browser such as Internet Explorer, Google Chrome, Mozilla Firefox, Opera, or Safari,

  • An active email address,

  • Cookies enabled.

5. General Information

  1. To the maximum extent permitted by law, the Seller shall not be liable for disruptions, including interruptions in the operation of the Store, caused by force majeure, unlawful actions of third parties, or the incompatibility of the online Store with the Customer’s technical infrastructure.

  2. Browsing the Store's product range does not require setting up an Account. Placing Orders for Products in the Store's assortment is possible either after creating an Account in accordance with §6 of these Terms or by providing the necessary personal and address details to fulfill the Order without Account registration.

  3. Prices in the Store are shown in Polish zloty (PLN) by default, and for foreign customers in euros (EUR) or local currencies. All prices include VAT (gross prices).

  4. The total amount payable by the Customer consists of the Product price and delivery costs (including fees for transport, delivery, and postal services), which the Customer is informed about on the Store's pages during the Order placement process, including the moment of expressing the will to conclude the Sales Agreement.

  5. In the case of a contract involving subscription or services for an indefinite period, the final price is the total amount covering all recurring payments within the settlement period.

  6. If, due to the nature of the subject matter of the Agreement, the exact price cannot be reasonably determined in advance, information on how the price is calculated as well as transportation, delivery, postal service, and other costs will be provided in the Product description.

6. Creating an Account in the Store

  1. To create an Account in the Store, the Registration Form must be completed by providing the following information: first name, last name, and email address.

  2. Creating an Account in the Store is free of charge.

  3. Logging into the Account requires the login and password established in the Registration Form.

  4. The Customer may delete the Account at any time, without giving a reason and without incurring any charges, by sending a request to the Seller, especially via email or in writing to the addresses provided in §3.

7. Order Placement Rules

To place an Order, the Customer must:

  1. Optionally log into their Store Account;

  2. Select a Product to be ordered and click the “Add to Cart” button (or equivalent);

  3. Log in or choose the option to place an Order without registration;

  4. If placing an Order without registration – fill in the Order Form by entering the recipient’s information and the delivery address, select the shipping method, and provide invoice data if different from the recipient's information;

  5. Click the “Order and Pay” button;

  6. Choose one of the available payment methods and, depending on the method, make the payment within the specified time, subject to §8 item 3.

8. Available Delivery and Payment Methods

Delivery options:

  • InPost courier,

  • InPost courier with cash on delivery,

  • InPost parcel locker,

  • InPost parcel locker with cash on delivery.

Payment options:

  • Cash on delivery,

  • Electronic payments via Shopify Payments,

  • Debit and credit cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro, Apple Pay,

  • Deferred payments via Klarna.

9. Execution of the Sales Agreement

  1. The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order using the Order Form in the Online Store, in accordance with §7 of the Terms and Conditions.

  2. After placing the Order, the Seller shall immediately confirm its receipt and simultaneously accept the Order for processing. Confirmation of Order receipt and acceptance is made by sending the Customer an email to the address provided during the Order process. This email must include at least the Seller’s statement of receipt and acceptance of the Order, and confirmation of the Sales Agreement. The moment the Customer receives this email, the Sales Agreement is considered concluded.

  3. If the Customer selects:

    • Electronic payment or card payment – the Customer must make the payment within 3 calendar days from the conclusion of the Sales Agreement; otherwise, the Order will be canceled.

    • Cash on delivery – the Customer must pay upon receipt of the shipment.

    • Cash upon personal pickup – the Customer must pay upon receipt, no later than 3 days from being informed that the Order is ready for collection.

  4. If the Order includes Products with different delivery times, the delivery date is determined by the longest indicated time.

  5. The delivery time of the Product to the Customer is calculated as follows:

    • For electronic or card payments – from the date the Seller’s bank account is credited.

    • For cash on delivery – from the date of conclusion of the Sales Agreement.

  6. If the Order includes Products with different availability times, the latest indicated availability time applies.

10. Right of Withdrawal

  1. The Consumer has the right to withdraw from the Sales Agreement within 14 days without providing any reason.

  2. The withdrawal period starts from the day the Consumer or a third party (other than the carrier) receives the Product.

  3. If the Agreement covers multiple Products delivered separately, in parts or batches, the withdrawal period starts from the receipt of the last item.

  4. In case of a subscription agreement (regular delivery), the period starts from the first Product received.

  5. The Consumer may withdraw by submitting a statement of withdrawal to the Seller. Sending the statement before the 14-day deadline is sufficient.

  6. The statement may be sent via traditional mail, email, or submitted on the Store’s website. Seller’s contact details are listed in §3. A sample withdrawal form is provided in Annex 1 to these Terms and in the Consumer Rights Act of May 30, 2014.

  7. If the statement is sent electronically, the Seller will confirm its receipt immediately via email.

Effects of Withdrawal

  • Upon withdrawal, the contract is considered not concluded.

  • The Seller will refund all payments made by the Consumer, including delivery costs (except extra costs related to non-standard delivery methods), within 14 days of receiving the withdrawal notice.

  • The refund will be issued using the same payment method unless otherwise agreed without cost to the Consumer.

  • The Seller may withhold the refund until the Product is returned or proof of return is provided.

  • The Consumer must return the Product within 14 days of withdrawal notice to:

  • The Consumer bears the direct return shipping costs and is liable for any decrease in the Product’s value due to handling beyond what is necessary to establish its nature, features, and functionality.

  • If the Product cannot be returned by regular post, information and return costs will be provided in the Product description.

No Right of Withdrawal

The right of withdrawal does not apply to contracts:

  • For non-prefabricated Products, made to the Consumer’s specifications or clearly personalized.

  • For services that have been fully performed with the Consumer’s prior consent and acknowledgment of losing the right to withdraw.

  • For goods that become inseparably mixed with other items after delivery due to their nature.

11. Complaints and Warranty

  1. All Products offered through the Store are new.

  2. If a purchased Product proves to be defective, the Customer has the right to file a complaint based on statutory warranty provisions of the Civil Code.

  3. Complaints should be submitted in writing or via email using the Seller’s contact details specified in §3 of these Terms and Conditions.

  4. The Seller shall respond to the complaint request promptly and no later than within 14 days. If the Seller does not respond within this period, the complaint is considered accepted.

  5. Products returned under the complaint procedure should be sent to:

  6. If a Product comes with a commercial warranty, details will be included in the Product description in the Store.

12. Out-of-Court Complaint Handling and Dispute Resolution

  1. Detailed information about the Consumer’s ability to use out-of-court complaint handling and redress procedures is available at:

  2. Examples of available procedures include:

    • Requesting dispute resolution by a permanent consumer arbitration court (Article 37 of the Trade Inspection Act of December 15, 2000),

    • Requesting mediation through the Provincial Inspector of Trade Inspection (Article 36 of the same Act),

    • Receiving free legal support from the municipal/poviat consumer ombudsman or consumer organizations.

13. Personal Data in the Online Store

  1. The Seller is the administrator of personal data provided by Customers through the Online Store.

  2. Personal data is collected for the purpose of fulfilling the Sales Agreement. With explicit consent from the Customer, it may also be used for marketing purposes.

  3. Data recipients may include:

    • Carriers or logistics providers when delivery is selected,

    • Payment service providers when online payment or card payment is selected.

  4. The Customer has the right to access and correct their personal data.

  5. Providing personal data is voluntary but necessary to conclude a Sales Agreement. Failure to provide the required data will prevent the transaction.

14. Reviews in the Online Store

  1. Customers may voluntarily and free of charge submit reviews of their purchases.

  2. Reviews may include a rating, description, and photo of the purchased product.

  3. After purchase, the Seller sends an email with a link to an online review form. If the Customer does not leave a review, a follow-up reminder may be sent.

  4. Only Customers who have actually purchased Products from the Store may submit reviews.

  5. Submitted reviews may be published on the Store's website and on TrustMate.io.

  6. Reviews may not be used for unlawful activities, including unfair competition, or to infringe on the personal rights, intellectual property rights, or other rights of the Seller or third parties.

  7. Reviews may only be submitted for Products actually purchased. Fake purchases and self-reviews by the Seller or employees are prohibited.

  8. Reviews can be deleted by the author at any time.

15. Final Provisions

  1. Contracts concluded via the Online Store are concluded in Polish.

  2. The Seller reserves the right to amend the Terms and Conditions for important legal or operational reasons (e.g. changes in the law, payment or delivery methods). Customers will be informed about any changes at least 7 days in advance.

  3. Matters not regulated in these Terms are subject to the applicable provisions of Polish law, in particular:

    • the Civil Code,

    • the Act on Provision of Electronic Services,

    • the Consumer Rights Act,

    • and the Act on the Protection of Personal Data.
